Failure to Report an Accident to the Local/Licensing Authority

The Offence

A Proprietor or Driver of a licensed vehicle shall report to the authority as soon as is reasonably practicable and in any case within 72 hours of the occurrence, any accident to a licensed vehicle causing damage materially affecting the safety, performance or appearance of the vehicle or the comfort or convenience of persons using the vehicle or rendering the vehicle.

Do I need an NIP (Notice of Intended Prosecution) for offences relating a Failure to Report an Accident?

No, there is not a requirement for an NIP for offences relating the failure to report an accident.

Punishment

Fine up to £1,000.

Defences

There is a defence available if owner can show that they were not aware that their vehicle had been involved in an accident.  However, this will be dependent on the facts of the case.  Therefore it is critical that the full circumstances of your case are examined to ensure your case is properly prepared.  If you face an allegation, we advise you contact us to take specialist legal advice.
