			<content:encoded><![CDATA[<p>According to a recent study drivers risk a possible rise by almost a quarter on their insurance premiums by receiving just one fixed penalty notice at 3 points.<span id="more-1543"></span></p>
<p>The study discovered that male motorists receiving a three point conviction can up their premiums by as much as 24%, for female motorists the average cost can be around 13%.</p>
<p>Penalty points generally stay on a licence for 4 years and this can cost as much as £692.00 for men and £276.00 for women over this time.</p>

<p>From a survey of 1900 people, only 15% think that fixed penalty notices are an effective deterrent for careless driving offences. An overwhelming 90% thought that if caught committing a road traffic offence that the driver should be given the option between accepting points or attending a driver awareness course. The survey indicates that rather than constantly add points to licences for bad driving habits a better approach would be to allow drivers the opportunity to improve their driving skills.</p>

<p>A Freedom of Information request made by the BBC found that there are 638 motorists in the South West that have racked up more than 12 points on their licences but are still driving. These circumstances can come about if the driver can prove in court that a mandatory driving ban would have a negative effect on others, generally called <a title="Exceptional Hardship" href="http://www.motordefenceteam.co.uk/knowledge-Guides/exceptional-hardship.htm">exceptional hardship</a>.</p>

			<content:encoded><![CDATA[<p>A quirk in the Irish court system that allowed over 17,000 drivers to avoid penalty points on their licence is to be closed<span id="more-646"></span></p>
<p>The loophole is a result of there being no legal requirement for court staff to pass on licence details to the Road Safety Authority. On occasions drivers wouldn&#8217;t bring their licence to court or court staff simply hasn’t collected the information. The Irish Courts say that the matter of following up such an offence of not presenting a licence is not a matter for the Courts Service. Changes to the Irish 2009 Road Traffic Act will prevent this loophole by insisting that drivers bring along at least a photocopy of their licence.</p>

He avoided the ban by putting forward mitigating circumstances, in particular that a driving ban would prevent him from taking his mother to the local GP.</p>

<p>The blunder identified the location of a speed camera wrongly on the legal paperwork which effectively means every ticket issued (nearly 25,000) since the order was drafted is invalid. The Partnership will refund fines and remove penalty points on licences as far back as 10 years. The error was discovered when a lorry driver challenged his ticket in court.</p>
