The most common circumstances where you can be charged with failing to identify the driver is with speeding offences from Gatso Cameras, usually involving company cars

The registered keeper of the vehicle has ultimate responsibility of providing the details of who was driving at the time of the alleged offence. If it is a company vehicle and the driver cannot be identified then the company secretary/director will be prosecuted for Failing to Supply Information. In some cases where it can be shown that every reasonable step was taken by the company to identify the driver a warning letter could be issued with a request to implement a proper logging out system for company vehicles. Repeat offenders would normally face prosecution.
