Still driving on 39 points

A motorists in Swindon has kept his licence even though he has 39 points on his licence

A Freedom of Information request made by the BBC found that there are 638 motorists in the South West that have racked up more than 12 points on their licences but are still driving. These circumstances can come about if the driver can prove in court that a mandatory driving ban would have a negative effect on others, generally called exceptional hardship.

    If those points were racked up as the result of being caught by a succession of Revenue Generator cameras then there is no evidence that the drivers were guily of anything other than exceeding a purely arbitrary speed limit that usually has nothing to do with safety. In such cases I could not care less.

    If those points were amassed as a result of successful prosecutions (by Traffic Police)for clearly demonstrable, videotaped evidence of dangerous, careless or reckless driving then, if those drivers are still on the road, irrespective of personal circumstances, there is clearly something very wrong with our judicial system.
